How does the ISTAT rent revaluation work?
The revaluation of the rental fee occurs annually based on the variation of the ISTAT consumer price index. This practice is provided by law and allows the fee to be adjusted for inflation.
What percentage applies?
- 75% of the ISTAT index: Generally for non-residential leases (art. 32 Law 392/78) and agreed-rent contracts (canone concordato, Law 431/98)
- 100% of the ISTAT index: For residential free-market contracts (4+4), if explicitly stated in the contract
With the cedolare secca flat tax regime, the ISTAT rent adjustment is suspended (Legislative Decree 23/2011, art. 3 c. 11).
When does the revaluation apply?
The revaluation applies starting from the expiration of each year of the lease, using the ISTAT index published for the month preceding the expiration date.
