Lawyer Invoice Calculator — Fee, CPA, VAT and Withholding Tax

Calculator

Lawyer Invoice Calculator

From the fee to the invoice total — 15% general expenses, 4% CPA, 22% VAT and withholding tax — or the reverse calculation from the net amount the client pays

Where you start from
Invoice items

The calculator starts from the fee already agreed or awarded and builds the other items of the invoice: it does not determine the bracket-based fees set by the tables of DM 55/2014, which depend on the value of the case, the subject matter and the stages actually carried out. Rates applied: general expenses 15% (art. 2 para. 2 DM 55/2014), Cassa Forense (lawyers’ pension fund) supplementary contribution 4% (art. 18 of the Regolamento Unico della Previdenza Forense), ordinary VAT 22%, withholding tax 20% (art. 25 DPR 600/1973) only towards clients who are withholding agents. It is an informational tool: for the actual invoice, for reduced rates and for your specific case, the reference remains your accountant and the Cassa Forense.

How a lawyer's invoice is calculated

A lawyer's invoice almost never matches the agreed fee: on top of the professional fee come flat-rate general expenses, the Cassa Forense (lawyers' pension fund) supplementary contribution and VAT (IVA), while the withholding tax is subtracted. This calculator builds the breakdown starting from the fee, or works it out backwards from the net amount the client pays (the reverse invoice, or extraction), entirely in your browser.

The scope, stated clearly: the tool starts from the fee already agreed or awarded by the judge. It does not determine the bracket-based fees of DM 55/2014, which depend on value, subject matter, judicial authority and stages carried out: for those, the ministerial tables remain the reference.

The invoice items and the order in which they are added

Each item has a different base: swapping them changes the total.

ItemRateCalculation base
Flat-rate general expenses15%Fee
Cassa Forense supplementary contribution (CPA)4%Fee + general expenses
Ordinary VAT22%Fee + general expenses + CPA
Withholding tax (subtracted)20%Fee + general expenses
Advances art. 15 DPR 633/1972—Outside every base: added only to the total

The flat-rate reimbursement of general expenses — equal to 15% of the fee, in addition to documented expenses (art. 2, paragraph 2, of DM 55/2014, as amended by DM 147/2022, which removed the words «as a rule») — covers the overhead costs of the law firm.

The 4% supplementary contribution — the CPA — is the surcharge applied to all fees included in the annual turnover for VAT purposes, chargeable to the client (art. 18 of the Regolamento Unico della Previdenza Forense, implementing art. 11 of law 576/1980). Two often-confused consequences follow: it is included in the VAT taxable base, but it is not included in the withholding tax base, because by law it is not an integral part of the professional fee.

The 20% withholding tax (ritenuta d'acconto) is an advance payment of IRPEF (personal income tax) that the client withholds and pays to the Treasury on behalf of the lawyer (art. 25 of DPR 600/1973). It is applied only by those who are withholding agents (sostituti d'imposta): companies, public bodies, professionals and VAT number holders under the ordinary regime. Clients under the flat-rate or advantage regime do not apply withholding tax (art. 1, paragraph 69, of law 190/2014): in that case choose «No». It is not an additional cost, but tax paid in advance that is recovered in the tax return.

Advances made in the name and on behalf of the client — court filing fee, revenue stamps, copy fees, service of documents — if documented are excluded from the taxable base (art. 15, no. 3, of DPR 633/1972): they are added only to the total.

Calculation example

Fee of 1,000 €, general expenses enabled, ordinary regime, client who is a withholding agent, 50 € of advances exempt under art. 15. These are the figures the calculator returns, to the cent:

ItemCalculationAmount
Fee—1,000.00 €
General expenses 15%1,000.00 × 15%150.00 €
Contribution base1,000.00 + 150.001,150.00 €
CPA 4% Cassa Forense1,150.00 × 4%46.00 €
VAT taxable base1,150.00 + 46.001,196.00 €
VAT 22%1,196.00 × 22%263.12 €
Art. 15 exempt expenses—50.00 €
Invoice total1,196.00 + 263.12 + 50.001,509.12 €
Withholding tax 20%1,150.00 × 20%− 230.00 €
Net amount payable1,509.12 − 230.001,279.12 €

Without the advances the total would be 1,459.12 €, with a net of 1,229.12 € towards a withholding agent and full collection from a private client. Under the flat-rate regime (regime forfettario), with neither VAT nor withholding tax, the invoice stops at 1,198.00 € (1,000 + 150 + 46 of CPA + 2 € of stamp duty), which is also the amount collected.

Reverse invoice: from net to fee

The opposite question is just as common: «I want to collect 1,000 € net, what fee should I charge?». The calculator solves it algebraically, not by trial and error. With general expenses enabled, ordinary regime and a client who is a withholding agent, the net is the fee multiplied by 1.22912, i.e. 1.15 × (1.04 × 1.22 − 0.20). For 1,000 € net the fee is 813.59 €: general expenses 122.04 €, CPA 37.43 €, VAT 214.07 €, total 1,187.13 €, withholding tax 187.13 €.

Flat-rate regime and stamp duty

A lawyer under the flat-rate regime (art. 1, paragraphs 54-89, of law 190/2014) does not charge VAT and their fees are not subject to withholding tax (paragraph 67), even when the client is a withholding agent. The 4% supplementary contribution, however, remains due and must be charged on the invoice as for all other members.

When the invoice does not include VAT, the principle of alternation between VAT and stamp duty applies: on amounts not subject to VAT exceeding 77.47 €, stamp duty of 2.00 € is due (art. 13 of the Tariff and art. 6 of Table B, DPR 642/1972). Under the flat-rate regime it applies to the whole invoice; under the ordinary regime only if the art. 15 advances exceed the threshold.

Limits of the tool

The calculator uses the ordinary rates: 15%, 4%, 22%, 20%. It does not handle non-taxable or exempt transactions, reverse charge, foreign clients, reduced VAT rates, state-funded legal aid (patrocinio a spese dello Stato), or the subjective contribution due to the Cassa on professional income. It is informational: for the actual invoice, the references remain your accountant, the Consiglio dell'Ordine (Bar Council) and the Cassa Forense.

Frequently asked questions

How is a lawyer's invoice calculated?

You start from the fee, add 15% for general expenses, apply the 4% CPA to the sum of the two and calculate VAT at 22% on fee, general expenses and CPA. Advances under art. 15 are added only to the total. If the client is a withholding agent, the 20% withholding tax on fee plus general expenses is subtracted.

Is the 4% Cassa Forense contribution calculated before or after VAT?

Before. The 4% supplementary contribution is calculated on fee plus flat-rate general expenses and forms part of the VAT taxable base: VAT at 22% is therefore applied to the sum of fee, general expenses and contribution. The contribution, however, stays outside the withholding tax base, because by law it is not an integral part of the professional fee.

When does a lawyer not apply withholding tax?

In two cases. When the client is a private individual, because they are not a withholding agent. And when the lawyer is under the flat-rate regime: fees of flat-rate taxpayers are not subject to withholding under art. 1, paragraph 67, of law 190/2014, whoever the client is.

How do you do the reverse calculation of an invoice?

You divide the net by the overall coefficient of the chosen regime, after removing the art. 15 advances and any stamp duty. With general expenses at 15%, ordinary regime and a client who is a withholding agent, the coefficient is 1.22912: to collect 1,000 € net you need a fee of 813.59 €, with an invoice total of 1,187.13 €. The calculator does this step automatically when you choose the «start from the net» mode.
